8/6/2020 – JCEA Compensation survey – your response determines our next steps

Bargaining recap from last night

In case you missed bargaining last night (Aug 5), or wanted further clarity regarding the exchanged proposals, here is your rundown. The district management team still has not come to the table to collaborate with us around the MOU for safer working conditions around the restart plan, so they switched things up and chose to bargain compensation last night instead.

First, let’s review the last compensation proposals from our last bargaining session in June:

District management proposal – no steps, no levels, no COLA, no job cuts.

JCEA counter proposal 1 – steps, levels, 1.25% COLA

Last night, the district management team came back with their first counter, we countered back, and they came with another counter.

District management counter 1 – levels (with a suspension of levels for 2021-2022), no steps, 0.5% lump sum money (not ongoing, not base-building). and the condition of a return to the bargaining table if the district experiences a significant change in revenue based on a recession of revenue from the state, or a return to the table if the district experiences an increase in revenue greater than $13 million.

JCEA counter 2 – steps, levels with no suspension for 2021-2022 (we can look at this later in the year if necessary), 1% lump sum money, an agreement to return to the bargaining table under the condition of what district management considers a “significant” (and we need a definition of ‘significant’) change in revenue due to a recession, and a return to the table if there is an increase in district revenues of $5 million or more.

District management counter 2 – no steps, levels and agree to take the 21-22 level suspension off the table (for now), 1% lump sum money, and a willingness to have a mutually agreed upon non-student contact day to take as a paid day off. The district team clarified that “significant” meant that they wanted to renegotiate given a $10 million increase or decrease in revenues.

We may be back at the table Monday and need this data. This will give critical member feedback to help guide your hardworking JCEA negotiations team fight for you! This will be a members-only survey, one of the benefits of membership.

Our bargaining team is communicating with the district to get at least two more bargaining sessions scheduled within the next few days. With in-service days for most licensed staff starting in less than a week, we know how urgent it is to negotiate our working conditions so we can return to our jobs in the safest way possible.

Our team hopes to meet tomorrow (Friday) to negotiate the MOU around our safe return, but our team is also available to meet over the weekend.

We need the district management team to have this same sense of urgency and come back to the table ASAP!

Back to compensation – we will likely continue negotiating compensation early next week. The district can allocate any negotiated and ratified back pay retroactively, so the MOU on a safer start is more time sensitive.

Based upon your feedback in this survey, we will make a counter proposal and see what their counter will be to that. It may or may not go back and forth with additional counter proposals until we come to a tentative agreement, which the JCEA membership will have to vote to approve, or otherwise we go to impasse.

If we agree tentatively on salary, then all JCEA members would vote to ratify, yes or no. If our members ratify, then the Board of Education would take a ratification vote. Your team’s goal would be to present the membership with an agreement that WOULD be ratified.

If we cannot agree on a tentative settlement, then we would go to impasse. When this has happened in the past, an outside arbitrator from the Federal Mediation and Conciliation Services (FMCS) would come and try to mediate a settlement. If THAT doesn’t work, we would go to fact-finding which would be an outside arbitrator who would hear evidence from both sides in a hearing, and then deliver an opinion. Fact finding can take quite some time. That process is NOT binding. We went to fact finding in 2014. We have also been at an impasse in the past and settled. After settlement, back pay would be issued.

Until we settle and ratify the tentative agreement, the CURRENT contract, including pay, is in effect.
